Privacy Policy

Last updated

This Privacy Policy explains how NEMA LOYALTY LLC, doing business as Cheer My Run (“Cheer My Run”, “we”, “us”, “our”), collects, uses, shares and protects personal data when you use the Cheer My Run mobile application, our websites at cheermyrun.com and live.cheermyrun.com, and related services (together, the “Service”).

We wrote this policy to be read. If anything is unclear, write to privacy@cheermyrun.com and a person will answer.

Who we are

The data controller (the company responsible for your personal data) is NEMA LOYALTY LLC, a Wyoming limited liability company, doing business as Cheer My Run.

ALEDIN LLC, an affiliated company under common control, may process personal data on our behalf and under our instructions to help operate, finance and support the Service. Where it does, this policy applies in full and both companies are bound by it.

We have not appointed a Data Protection Officer because we are not required to. You can reach the person responsible for privacy at the address above.

Who this policy covers

This policy covers three kinds of people:

  • Runners who create an account in the app, track runs and races, and receive cheers.
  • Supporters who open a runner’s share link or race code on live.cheermyrun.com to follow a run and send cheers. Supporters do not need an account.
  • Visitors to cheermyrun.com.

It does not cover third-party services you reach through the Service, such as Apple, Google, or your headphones or watch manufacturer. Their own policies apply.

Data we collect

Account and profile data (runners). Your first and last name, username, email address and/or phone number, the sign-in provider you used (Apple, Google or phone verification code), your profile photo or avatar, and your unit preference. If you sign in with Apple and choose “Hide My Email”, we receive Apple’s relay address instead of your real one.

Onboarding answers (runners). During setup we ask about your running experience, favourite distance, age range, gender identity, running goals and motivations, how you usually carry your phone, whether you use headphones or a watch, how you found us, and the name and date of your next race. These answers personalise the app and the messages we send. All of them are optional or skippable and you can change them in your profile.

Location data (runners). When you start a run or race, the app collects your precise GPS position, pace, distance, elevation and heading in real time, including in the background while the app is running, so that your supporters can follow you and cheers can be triggered at the right point of the course. Location is only collected during an active run. You can revoke location permission at any time in your device settings; live tracking will then not work.

Cheers and user content. Supporters can record short voice messages, type text cheers and choose emojis for a runner. We store the audio file, an automatic transcription and, where you enable it, a machine translation, together with the supporter’s display name and the point of the race where the cheer should play. Runners can favourite and replay cheers.

Supporter data. Supporters give us a display name and, optionally, an email address to be notified when the runner starts. We also receive the technical data described below for the web page.

Subscription data. Whether you have an active subscription, the plan, the start and renewal dates, the store (Apple App Store or Google Play), the country of your store account and the price paid. Payments are handled entirely by Apple or Google. We never receive or store your card number or bank details.

Device and technical data. Device model, operating system version, app version, language and time zone, IP address and approximate country derived from it, push notification tokens, a random installation identifier, the Apple identifier for vendors (IDFV) and, only if you allow tracking when iOS asks (App Tracking Transparency), the advertising identifier (IDFA) or the Google Advertising ID.

Usage and diagnostics. Which screens you open, buttons you tap, features you use, paywall views and purchases, crash logs and performance data.

Communications. Messages you send to support, feedback you submit in the app, cancellation reasons, and your email preferences and unsubscribe status.

Data from partners. If you install the app after tapping an advertisement, our attribution provider tells us which campaign led to the install. We do not receive your social media profile or activity from the ad network.

How we use your data

  • Provide the Service: create and secure your account, track your runs, broadcast your live position to the supporters you share a link with, deliver cheers to your headphones, keep your history and favourites.
  • Personalise: use your onboarding answers, race name and race date to tailor the app, the paywall and the messages we send you.
  • Payments and entitlements: verify purchases with Apple or Google, unlock premium features and restore them on a new device.
  • Notifications: send push notifications about your races, cheers received, reminders you asked for, and account or subscription events.
  • Communicate with you: answer support requests and send service emails (for example about a change to these terms or a security issue).
  • Marketing: send email newsletters and offers as described in the “Marketing communications” section, and measure the results of our advertising in aggregate.
  • Improve and secure: analyse usage, fix bugs and crashes, prevent fraud and abuse, and develop new features.
  • Comply with law: keep records we are legally required to keep and respond to lawful requests.

We do not make decisions about you with legal or similarly significant effects using automated processing alone.

Marketing communications

If you have an account, we may email you about product news, running tips, race-week guides, and seasonal offers or discounts on Cheer My Run subscriptions. We aim for about two emails a month and we never sell or rent our list.

You can stop at any time. Every marketing email has a one-click unsubscribe link, and you can turn email updates off in the app under Settings → Notifications. Unsubscribing does not affect service emails that we need to send you, such as a receipt of account deletion or a notice about a change to these terms.

We measure whether emails are opened and which links are clicked so that we can send fewer, better messages. We do not email supporters who have not created an account, except the single race-start notification they asked for.

Push notifications are governed by your device permission; you can switch them off in the app or in your device settings.

How we share data

With your supporters. When you share a run, anyone with the link or race code can see your display name, avatar, live position, pace, distance and the cheers sent to you until the run ends. Choose who you share the link with.

With service providers (processors) who work under contract and only on our instructions:

With app stores. Apple and Google process your payment and know which subscriptions you hold under their own privacy policies. We receive purchase confirmations from them.

With advertising platforms for measurement. To know whether an advertisement led to an install or a purchase, our attribution provider may send Meta (Facebook, Instagram) and TikTok an install or purchase event together with a hashed or resettable device identifier, and only where you have allowed tracking on iOS. We do not send your name, email, location, cheers or onboarding answers to advertising platforms.

With our affiliate. ALEDIN LLC may access data as described under “Who we are”.

When the law requires it, to protect the rights, safety or property of runners, supporters or the public, or in connection with a merger, acquisition or sale of assets, in which case this policy continues to apply to your data.

We do not sell personal data and we do not “share” it for cross-context behavioural advertising as those terms are defined in California law.

International transfers

We are based in the United States and our providers store data in the United States and the European Union. If you live outside the United States, your data will be transferred there. For transfers from the EEA, the United Kingdom and Switzerland we rely on the European Commission’s Standard Contractual Clauses (and the UK Addendum) with each provider, or on the EU-U.S. Data Privacy Framework where the provider is certified. You can ask us for a copy of the relevant safeguards.

Your rights and choices

Depending on where you live, you may have the right to access the personal data we hold about you, correct it, delete it, receive a portable copy, object to or restrict certain processing, withdraw consent at any time, and not be discriminated against for exercising these rights. Residents of the EEA, the United Kingdom and Switzerland (GDPR and UK GDPR), Brazil (LGPD), California and other US states (CCPA/CPRA and similar laws), Canada (PIPEDA) and Australia (Privacy Act) all have rights of this kind.

In the app: edit your profile and onboarding answers, change your unit preference, manage push notifications and email updates under Settings, revoke location, microphone and tracking permissions in your device settings, and delete your account.

By email: write to privacy@cheermyrun.com from the address linked to your account, or tell us your username or phone number so that we can verify you. We answer within 30 days (45 days for CCPA requests, extendable once with notice). We do not charge for a first request. An authorised agent may act for you if you give them written permission.

Complaints. You may lodge a complaint with your local data protection authority. In the EEA you can find yours through the European Data Protection Board; in the UK it is the Information Commissioner’s Office; in Brazil the ANPD. We would appreciate the chance to answer first.

Do Not Track and Global Privacy Control. Our website does not use cross-site tracking, so there is nothing to opt out of; analytics on cheermyrun.com only load after you accept them in the banner and you can withdraw that choice in the footer.

Deleting your account

You can delete your account yourself at any time. Deleting removes your profile, onboarding answers, runs, routes, location history, cheers, favourites and device tokens, and unsubscribes you from all emails. Purchase records that we must keep for tax and accounting purposes are retained in a form that no longer identifies you within the Service.

  1. Open the Cheer My Run app and go to Settings.
  2. Under Account, tap Delete account.
  3. Confirm. Deletion starts immediately and completes within 30 days.

If you cannot access the app, email support@cheermyrun.com with the subject “Delete my account” from the email address on your account, or include your username and phone number, and we will do it for you and confirm by email.

Children

The Service is not directed at children under 13, or under 16 where the law of your country sets that age for consent to data processing. We do not knowingly collect personal data from children below those ages. If you believe a child has given us data, contact us and we will delete it.

Security

All traffic between the app, our websites and our servers is encrypted in transit (TLS). Data is encrypted at rest by our hosting providers. Access to production systems is limited to the people who need it, protected by multi-factor authentication and logged. Sign-in is handled by Google Firebase Authentication; we never see or store your Apple or Google password. No system is perfectly secure, and we will tell you and, where required, the authorities without undue delay if a breach affects your data.

Changes to this policy

We may update this policy as the Service or the law changes. The date at the top shows when it was last revised. For material changes we will notify you in the app or by email before they take effect. Earlier versions are available on request.
